Description
Action for damages begun June 16, 1953, by Hilda Thelen against Alfred Machotka and his employer, Film Service, Inc., and
its insurer, Home Indemnity Company. Originally, Alouis P. Thelen, the driver of the automobile in which plaintiff was riding,
and his insurer, Farmers Mutual Automobile Insurance Company, were defendants, but they are not involved in this appeal. Trial was to court and jury. A special verdict was rendered finding Alfred Machotka negligent in the management and control
of his employer's truck, in causing the collision between the automobile in which plaintiff was riding and the truck driven
by him. There were other questions submitted with respect to speed and to yielding 'at least one-half of the main travelled
portion of the highway.' The jury found Alouis P. Thelen causally negligent in the operation of his automobile with respect
to speed, management and control, and failing to give 'the defendant, Alfred Machotka, at least one-half of the main travelled
portion of the roadway.' There was a comparison of negligence. Judgment was granted January 12, 1954 in favor of the plaintiff,
Hilda Thelen, and against Alfred Machotka, and Home Indemnity Company. These defendants appeal.
